These Terms of Use are an agreement between you and AtomSparq Ltd ("we", "us") covering your use of the TravelJotter app. Apple's standard Licensed Application End User License Agreement (EULA) governs your licence to use an app downloaded from the App Store. These Terms supplement that EULA with additional conditions concerning TravelJotter's features and calculated information; they do not replace it. By using TravelJotter, you accept both.
Please read the first section carefully — it is the most important part of this document.
Not for official, legal, tax, or visa purposes
TravelJotter is a personal record-keeping tool. Its day counts, statistics, and summaries are estimates, calculated from information you entered yourself, using simplifying assumptions the app is open about (see the in-app Help). They may be incomplete, imprecise, or wrong. Software defects, calculation errors or synchronisation problems may produce incorrect results even when the information you entered is complete and accurate.
You must not rely on TravelJotter or its outputs for:
- visa or immigration applications or compliance,
- tax residency, tax filings, or day-counting for tax purposes,
- legal residency, citizenship, or right-to-remain matters,
- any other legal, governmental, or official purpose.
For any such purpose, rely on official records (passport stamps, travel documents, carrier records) and seek advice from a qualified professional. Using the app or its data for one of these prohibited purposes is outside the purpose for which TravelJotter is provided. To the fullest extent the law allows, we are not responsible for consequences arising from such use. This is confirmed by you during the app's setup, and it is a condition of using the app.
Ownership and permitted use
Your licence to use TravelJotter is provided under Apple's standard EULA. TravelJotter, its software, and its design remain the property of AtomSparq Ltd and its licensors. You must comply with the EULA and any applicable third-party terms when using the app. You may not copy, modify, redistribute, or reverse-engineer the app except where the EULA or the law permits it.
Your data and your responsibility
Everything you record in TravelJotter is yours, and it stays under your control and, when iCloud is available to TravelJotter, in your own iCloud (see the Privacy Policy). You control TravelJotter's access to iCloud through your device's Settings.
With that control comes responsibility: you are responsible for taking reasonable steps to safeguard your own data. The app provides recovery snapshots and export tools, and we recommend exporting your data periodically and keeping an independent copy somewhere safe. Neither these tools nor iCloud sync guarantee that data will never be lost, altered or corrupted. Software defects, synchronisation problems or other errors could cause records to differ from what you originally entered, even when entered correctly.
Subject to your mandatory legal rights, we are not responsible for data loss or corruption to the extent caused by circumstances outside our reasonable control that we could not reasonably have prevented, such as loss of your device or your intentional deletion of records.
Original photos and videos attached to trips remain in your photo library and are subject to its own storage and backup arrangements. TravelJotter stores references and associated metadata, but not copies of the original media.
Acceptable use
Use TravelJotter lawfully and as intended: as a personal travel journal. Don't attempt to interfere with the app's operation or use it in a way that infringes others' rights.
The app is provided "as is"
We work to make TravelJotter dependable, but we do not guarantee uninterrupted or error-free operation, compatibility with every device or service, accurate or complete results, or that stored data will remain intact. Software defects, synchronisation problems and other errors may cause incorrect results or data to be lost, altered or corrupted, even when entered correctly. Keep independent backups of important records. TravelJotter is provided on an "as is" and "as available" basis, subject always to any warranties or other rights that cannot lawfully be excluded.
Limitation of liability
TravelJotter is provided for personal and non-commercial use. To the fullest extent the law allows, we are not responsible for:
- business losses, including loss of profit, revenue, business, opportunity, or anticipated savings;
- losses to the extent caused by inaccurate or incomplete information that you entered;
- losses arising from use of TravelJotter for a prohibited visa, tax, immigration, legal, governmental, or official purpose;
- failures or losses caused by Apple services, your device, your network, or another service outside our reasonable control, where we could not reasonably have prevented them; or
- data loss in the circumstances described under "Your data and your responsibility" above.
Nothing in these Terms affects your statutory consumer rights or excludes or limits liability where doing so would be unlawful.
Changes to the app and these Terms
We may update, change, or discontinue features for operational, security, legal, or product-development reasons. Where reasonably practicable, we will give notice before a change that materially reduces the app's functionality. Any mandatory rights you have under applicable law remain unaffected.
We may also update these Terms. If we make material changes, we will update the effective date above and inform you in the app before the changes take effect. For changes to the core no-reliance disclaimer, the app will ask you to review and accept it again.
Termination
You can end these supplemental Terms at any time by deleting the app. Your licence under Apple's standard EULA may end in accordance with that EULA. The sections on no-reliance, ownership, and limitation of liability continue to apply where relevant after termination.
Governing law
These Terms are governed by the laws of England and Wales, without affecting any mandatory rights or access to courts that you have under the law where you live.
